Indiana Rules of Trial Procedure have been updated as of 10/31/2017 - Order Amending Rules of Trial Procedure

The following legislative updates have been made to the state court e-filing as of July 1, 2017:
It is imperative that the correct type of case is selected when filing an initial pleading. There is now a case type of “PL” – Will Contest.
If you do not know which filing code to utilize, if it is an initial pleading utilize “Petition”, if it is a subsequent pleading utilize “Motion”. This alerts the Clerk to stop and review the pleading to determine the correct filing code it should be given and direct it to the appropriate location.
When issuing a summons, you must e-file with the court and receive the file-stamped summons back from the Clerk prior to serving. WE ARE RESPONSIBLE FOR SERVICE – the Clerk will not serve any summons. Once we serve the summons, we are required to e-file a Certificate of Issuance of Summons (which category is listed under the filing code when going through the e-filing process) indicating how it was served and the date it was served. If service is obtained via Certified Mail-Return Receipt Requested, we can either have the green card addressed to be returned to the Clerk’s office of the specific county/court OR if we leave the return address to YOUR LAW FIRM, we then need to notify the court that service was perfected once the green card is received.
When filing a motion, summons and order – we will need to serve the motion and the summons (we will receive a file-stamped copy from the court to serve after the e-filing has been accepted) (our choice of how we would like to serve) – once again filing a Certificate of Issuance of Summons (as described above) and the Court will be responsible for serving the Order. The Order will only be served upon the recipients they have e-mail addresses and/or mailing addresses for. All other recipients listed will need to be served with a copy of the Order by the filing attorney. As stated above, if service of the summons is obtained via Certified Mail-Return Receipt Requested, we can either have the green card addressed to be returned to the Clerk’s office of the specific county/court OR if we leave the return address to YOUR LAW FIRM, we then need to notify the court that service was perfected once the green card is received.
If there are parties on the Certificate of Service that are not in the “Party Information” section of the e-filing process, the filing attorney is responsible for serving all filings initiated by him/her AND, if an order is received associated with the filing (whether our proposed order or an order issued by the court), it is the responsibility of the filing attorney to serve all recipients on the Certificate of Service that are not listed on the “Party Information” section. NOTE: It would be a good practice to include this information at the top of the Standard Information Document (i.e. – we are responsible to serve all initiated pleadings and any court order obtain therefrom on any recipient not listed in the “Party Information” section of the e-filing process).
In the “Filings” section of the e-filing process, sending a courtesy copy to an attorney IS NOT valid service. This courtesy copy category is typically utilized to include client e-mail addresses so they receive a copy of the filing.
As of July 1, 2017, filing fees have been reduced – only in e-filings (both initial and subsequent). If the court is still utilizing paper filing, the court costs have not been reduced. When e-filing an initial pleading, it no longer cost $10.00 for each additional defendant to the case. Again, if still a paper filing court, then the cost for each additional defendant remains at $10.00.
If an e-filing is rejected by the court, an Order to Strike will be issued by the court and then we have 72 hours to correct the rejected filing. If re-filed within the 72 hours, the initial date of the rejected filing will be affixed to the pleading.
Each attorney is required to accept e-service in any case in which they e-file. You agree to e-service by adding yourself to the Public Service List, which must be done at the same time you file your appearance.
